Please read these Terms and Conditions carefully before registering on the Platform.

These Terms and Conditions (“Terms”) govern your registration on, participation in and use of the online lottery services (“Services”) provided by Great Goa Games (“GGG”) through its website www.ggglottery.com and mobile application (collectively, the “Platform” and may also be referred to as “we”/ “us”). GGG is operated by M/s Dazzlecrest Private Limited (“Company”), which is an authorized licensee of the Directorate of Small Savings and Lotteries, Government of Goa (“Government”) and has been appointed as the Marketing Agent to market and sell online lottery tickets for Sets 4, 5 and 6 of the Goa State Online Lotteries organized and conducted by the Government (“Lottery(ies)”). The Lottery is being organized basis schemes as approved by the Government (“Lottery Schemes”).

These Terms, “Privacy Policy”, “Cookie Policy”, “Cancellation and Refund Policy”, and rules of the online Lottery Schemes offered on the Platform (collectively referred to as “Platform Policies”) form a binding legal agreement between you and the Company, basis which you may visit, access or use the Platform and its Services.

Users are advised to carefully read the rules of each Lottery Scheme before purchasing a Lottery ticket under the said Scheme from the Platform.

By registering on and using the Services of the Platform, you (“Participant”, “you”, “your”) agree to comply with and be bound by these Terms. If you do not agree with these Terms, you are advised to discontinue using this Platform immediately.

Eligibility

1.   By visiting, accessing and using the Services of the Platform, you agree and undertake that you:

  • Are residing in India and above 18 years of age to participate in the Lottery;
  • Have read, understood and agreed to the Terms and agree to be bound by these Terms;
  • Are physically present in a jurisdiction in India where conduct of online lottery is allowed;
  • You shall only access the Platform and its Services from such jurisdiction(s) where sale and purchase of online lottery tickets is permitted as per the Central and respective State laws;
  • Will comply with all applicable State and Central laws pertaining to lotteries in India;
  • Will comply with all Platform Policies, including any terms and rules governing the Lotteries available on the Platform, and will remain in compliance of all applicable Central and State laws at all times.
Modifications to the Terms

2.   The Platform reserves the right to amend these Terms at any time and from time to time without prior notice. Any modifications to these Terms will come into effect immediately on their publication on the Platform. However, Users shall be notified of any significant changes to these Terms upon logging in into the Platform. For all other changes, you are requested to peruse these Terms periodically. Your continued use of the Platform signifies acceptance of any updated Terms.

Registration and maintenance of User Account:

3.   Users must create an account on the Platform in order to participate in the Lottery by providing accurate and complete information during the registration process. In case of any change in any user details, the User will update their profile (Know Your Customer) details.

4.   You will receive a one-time password (OTP) on the mobile number provided by You, for the purpose of verification , sign in and claiming your winning amount. User account is successfully created only upon verification of your mobile number via OTP verification process along with any additional verification, if implemented by the Platform.

5.   Valid and accurate personal information: You are required to register on the Platform only using your own personal information and your current and valid credentials. You hereby undertake to provide only current and valid credentials and completely accurate information. If there is any inaccuracy in the information furnished by a person or if a person is found using anyone else’s personal information, including any credential, to register and/or use the services of the Platform, action will be taken against such person. Please note the information provided by you prior to purchasing a Lottery ticket will be used if you win a prize and therefore, cannot be modified at a later stage. If the details provided by you are found to be incorrect and/or inadequate, the prize amount will be forfeited, in addition to any other action as may be taken against you for breaching these Terms and applicable laws.

6.   You undertake that you will not permit anyone else to access the Services of the Platform through your User account nor access the Platform Services through another User’s account. You represent and warrant that you shall not share your credentials/account details with any other person. Sharing or receipt of the Platform login details with any person/User/group or third party is strictly prohibited. In such an event wherein your credentials/ account details have been shared with a third-party you shall keep the Platform, the Company and its affiliates fully indemnified from any damage/injury resulting therefrom.

7.   No User shall be allowed to participate in the Lottery if such Users have been previously blocked or suspended by the Platform.

8.   You agree to promptly notify the Platform if you become aware of or suspect that there may have been any unauthorised usage of your username and/or password and/or personal details including mobile number on the Platform. You may contact: support@greatgoagames.com to seek any assistance in relation to any security concerns or Platform Policies.

9.   Your User account remains subject to your continued compliance of the Platform Policies and of applicable laws. The Platform reserves the right to suspend, terminate or block your access to the Platform at any time for reasons it deems fit, including to protect the safety and integrity of the Lottery, the Platform and of its Users.

10.   The Platform employs appropriate security measures and procedures in line with industry practices to ensure the compliance of the Platform Policies by the Users.

Usage of Services of the Platform:

11.   The registration on the Platform does not guarantee a User’s right to purchase a Lottery ticket.

12.   The following persons shall be automatically ineligible to purchase a Lottery ticket or claim prize money:

  • Minors: Anyone under 18 years of age is not allowed to buy a lottery ticket or claim prize money, whether on their own or acting on behalf of someone else; or
  • Persons whose User account has been suspended/terminated/blocked for any reason will not be eligible to participate; or
  • Geographical restrictions: Any person who resides in a State or location where access to the Platform is not permitted; or
  • If the Platform detects that any person is found to be impersonating another person or using details of another person to register and/or access the Services of the Platform.

13.   You are prohibited from using the Platform:

  • for any unlawful or illegal purpose/object or in any manner that may violate any of the applicable laws;
  • In any manner that may directly or indirectly harm the Government, the Company or its directors, employees, affiliates, distributors, partners, agents, retailers, service providers, the Platform and/or any User;
  • to infringe the intellectual property rights of the Company in any way, including by removing any copyright and other proprietary notices contained in any content on the Platform or in relation to the Services;
  • to copy, decompile, reverse engineer, or attempt to discover any source code or to sell, assign or transfer any intellectual property in the Platform;
  • Any attempts to gain access to the Platform through unauthorised means will lead to permanent exclusion from the Platform;
  • to send any unsolicited or unauthorized advertisements, promotions, marketing materials or communications;
  • in any manner that is not consistent with these Terms or violates any of the Platform Policies.

14.   Geographical restrictions:

  • The Services of the Platform are not intended to be offered or sold in any State or jurisdiction which is a Lottery-Free Zone or which prohibit online lottery operations in their respective territories (“Unauthorized Jurisdiction”). Therefore, Users present or residing in an Unauthorized Jurisdiction are strictly prohibited from purchasing Lottery tickets offered by the Platform.
  • The laws governing online lotteries in India are subject to change over time. As each State has its own lottery policy, it is Your responsibility to ensure that Your participation always complies with local laws and regulations.
  • The Services of the Platform are only available to Users located in jurisdictions where sale and purchase of online Lottery Tickets is permissible as per the relevant State and Central lottery laws. By registering on the Platform and accessing the Services of the Platform, you undertake that you are physically present in online lottery-permissible areas.
  • Under applicable Indian laws, you are prohibited from purchasing any lottery tickets in violation of the applicable laws and rules. In the event, you provide false information, commit misrepresentation or attempt to circumvent the Platform software for registering on or accessing the Services of the Platform in an unauthorized manner, strict action will be taken against you, including but not limited to termination of your User account, forfeit of prize amount and/or initiation of legal proceedings against you, as sought fit by the Company in its sole discretion.
  • Any purchase of a Lottery ticket from the Platform by a person in an Unauthorized Jurisdiction will be forfeit and no claim for prize money, if any, will be entertained.
  • In any event, the Platform or the Company shall have no liability whatsoever if you access or attempt to register on the Platform from an Unauthorized Jurisdiction, provide any false information or use any unauthorized measures for purposes of unlawfully accessing, registering and using the Platform.
Lottery Tickets, Draws and Prizes:

Lottery Tickets:

15.   The Users can purchase the Lottery Tickets from the Platform only. Any lottery ticket not purchased through the Platform will not be considered a valid Lottery ticket for participation in the Lotteries offered on the Platform and will not be considered for any prize claims.

16.   You may purchase tickets only through the payment methods provided on the Platform or through registered Retailers in State/s,where the sale and purchase of online lottery tickets is permitted .

17.   Lottery tickets purchased by a User are non-refundable subject to certain exceptions if provided in the “Cancellation and Refund Policy”.

18.   Lottery tickets will be available for purchase by the Users until 5 (five) minutes before each draw is conducted by the Government.

Lottery Draws:

19.   Each Lottery will have specified ticket amount, entry dates, draw dates, and prizes, which will be published on the Platform.

20.   The draws shall be held as per the procedure prescribed in the applicable Central and Goa State Lottery Rules at any public place located within the territory of Goa in the presence of the Draw Committee appointed by the Government.

21.   The Government reserves the right to change the date and time of the draw or to cancel the draw.

22.   No draw shall be held on National Holidays i.e. on 26 January, 15 August, and 2 October, or any holidays declared by the Government of Goa.

23.   The draw is conducted by the Directorate of Small Savings and Lotteries, Government of Goa.

24.   The Lottery Scheme provided by the Platform to its Users has been approved by the Government.

25.   The number of prizes for every Lottery draw shall be as per the Lottery Scheme approved by the Government, which may increase or decrease the percentage of the prize structure.

26.   The Lottery Schemes are subject to change by the Government from time to time.

27.   The winner(s) of the Lottery will be determined through a fair and transparent draw and the process will be automated. The results of the draw shall be announced and published by the Directorate of Small Savings and Lotteries. Such publication will be deemed to be the final and official announcement of the result of the draw.

28.   Upon receipt of the certified copy of the results from the Government, the Platform will publish the results immediately and no later than 24 hours from the time of receipt of such certified copies of the said results.

Prizes:

29.   Verification of results is the sole responsibility of the Users. Users are advised to verify the winning numbers with the official publication of the results issued by the Directorate of Small Savings and Lotteries, Government of Goa.

30.   Winners must claim their prize within 30 (thirty) days from the date of the announcement of the results of each Lottery draw (“Claim Period”). Failure to do so will result in forfeiture of the prize. No claim shall be entertained after the expiration of the Claim Period.

31.   Prizes below and upto INR 10,000/- will be disbursed by the Marketing agent. The prizes above INR 10,000/- will be disbursed jointly by the Marketing agent and Directorate of Small Savings and Lotteries, Government of Goa.

32.   In case you have won a Lottery, you can claim your winning amount within the Claim Period in the following manner:

  • For prizes upto INR 10,000/-: You will have to ensure that your Bank details are updated on the Platform under “Profile” section after log in.
  • For prizes above INR 10,000/-: You will have to ensure that your Bank details are updated on the Platform under “Profile” section after log in. In addition you will also have to fill and download the completed and signed copy of the “Claim Form”. The filled-in and signed Claim form needs to be submitted by post along with submission of the hard copies of the documents as may be stated in the Claim Form addressed to the Director, Directorate of Small Savings and Lotteries, Government of Goa.

33.   The Platform will satisfy itself of the genuineness and authenticity of your claim, including the accuracy of the details submitted by you, the Lottery ticket, and other credentials, and the Platform’s decision in this regard shall be final and binding on the claimant. After being satisfied, the winning amount, after applicable deductions, will be credited in the bank account provided by the user under the profile section.

34.   For prizes above INR 10,000/-, in addition to the verification by the Platform, the Government may also conduct the verification of the claim. In this regard, the decision of the Government with respect to the genuineness of the claim will be final and binding on the claimant.

35.   The claim shall be rejected if its genuineness cannot be established.

36.   The payment of prize money shall be in accordance with and as per the provisions of the applicable laws and rules and subject to applicable deductions.

37.   Prizes are non-transferable.

38.   Please note the release of the winning amount is subject to your compliance of all the Platform Policies and of all applicable laws. If any violation is suspected, the winning amount may be withheld. If the same is confirmed, the winning amount will be forfeited. If the winning amount is already disbursed, the User will be liable to repay the same to the Platform and/or the Government, as the case may be.

Taxes and Fees

39.   You acknowledge that the Platform may charge a service fee, which will be disclosed at the time of purchase of any Lottery tickets from the Platform, if applicable.

40.   You are responsible for all taxes, duties, or charges arising from your participation in the Lottery.

41.   You acknowledge that the prize amount will be disbursed to you after deduction of all applicable taxes, charges, expenses, fees, etc. as may be applicable to the prize amount.

Suspension and Termination of User Account

42.   The Platform reserves the right to suspend/terminate/block or ban User accounts if the Platform suspects or identifies any violation of any of the Platform Policies and/or any of the applicable laws. Upon the occurrence of any such event, the Platform may be required to provide User details, User data and other relevant information to the concerned authority, regulatory body, courts, in compliance with applicable laws or court orders/judgments, notifications, etc.

43.   The Platform reserves the right to suspend or terminate your Account immediately and any prizes, winnings or funds therein may be forfeited in the event of any violation of the Platform Policies, applicable laws or any fraudulent activity having been committed by the User. It also reserves the right to initiate appropriate civil and/or criminal action against the User in case of violation of any of the Platform Policies or of any of the applicable laws.

44.   The Platform reserves the right to block any claim request for winning a lottery draw including in cases where the Platform identifies any cyber fraud or any other fraudulent activity related to a User’s account by a governmental, police or any law enforcement authority or agency or during its own surveillance or investigation.

45.   The Platform may deny access to its Lottery, its Platform or any of its portion thereof without notice if the Platform is convinced of the presence of any unauthorised access or use by you, attempt to assign or transfer of any and all rights granted by the Platform to you under this Agreement and violation of any of the provisions of these Terms or any other Platform Policies.

46.   Discontinuation/Deactivation: Users are free to discontinue using the services on the Platform at any time by sending us an email indicating such intention at support@greatgoagames.com with the subject “Request to Deactivate”.

Representation and Warranties

47.   You represent that:

  • You are eligible and competent to enter into the Lottery/ies offered on this Platform;
  • You are physically present in a jurisdiction in India where conduct of online lottery is allowed, and you undertake that you shall always access the Platform and use its Services only from such jurisdiction(s) where sale of online Lottery tickets is permitted as per the Central and respective State laws;
  • You will ensure that the information provided by You to us at the time of registering on this Platform and also during your usage of this Platform, including your password, other personal details, bank details etc, is protected and no such information is disclosed to any third party. The Platform shall not be responsible for any breach of data committed on your behalf. You specifically understand and agree that the Platform will not incur any liability for information provided by You to anyone which may result in Your account being exposed or misused by any other person.
  • You have the requisite knowledge required to play Lottery on the Platform, and that You are not aware of any physical or mental condition that would impair Your capability to participate in the Lottery offered on this Platform;
  • You understand that the Platform shall not be liable for any loss or consequences that you may sustain as a result of your use of the Platform;
  • You agree to indemnify and hold the Platform, the Company, its employees, directors, officers, and agents harmless with respect to any and all claims and costs associated with your use of the Platform.
  • You understand and accept that Your participation in the Lottery does not create any obligation on us to give You a prize. Your winning a prize is entirely dependent on the outcome of the Lottery draw, and subject to the Platform Policies and applicable laws and your compliance thereof;
  • You agree and acknowledge that Your account will be used exclusively for participating in the Lottery draws and for no other purpose.
Responsible usage of the Platform
  • You are eligible and competent to enter into the Lottery/ies offered on this Platform;
  • You are physically present in a jurisdiction in India where conduct of online lottery is allowed, and you undertake that you shall always access the Platform and use its Services only from such jurisdiction(s) where sale of online Lottery tickets is permitted as per the Central and respective State laws;
  • You will ensure that the information provided by You to us at the time of registering on this Platform and also during your usage of this Platform, including your password, other personal details, bank details etc, is protected and no such information is disclosed to any third party. The Platform shall not be responsible for any breach of data committed on your behalf. You specifically understand and agree that the Platform will not incur any liability for information provided by You to anyone which may result in Your account being exposed or misused by any other person.

  • You agree and acknowledge that Your account will be used exclusively for participating in the Lottery draws and for no other purpose.
Responsible usage of the Platform

48.   At this Platform, we are committed to providing a safe, fun, and secure environment to all of our Users. We believe that participating in Lottery should be an enjoyable experience, and we encourage responsible gaming. To help you stay in control of your playing habits, we have developed the following Responsible Gaming Guidelines:

  • Know Your Limits
    • Set a Budget: Before engaging in any Lottery Games, set a limit on how much money you are willing to spend. Only play with money you can afford to lose.
    • Set Time Limits: Decide how much time you want to spend on Lottery Games each day or week. Stick to these limits to prevent excessive participation.
  • Ascertain the Risks

    • If you are concerned about your playing habits or need support, we encourage you to seek help from a professional service that offer free, confidential advice for individuals struggling with gambling problems.
  • Trusted Payment Methods:
    • Choose safe and secure payment methods that allow you to control your deposits and withdrawals.
    • Never borrow money for the purpose of participating in lottery. Only use funds that you can afford to spend.

49.   The Platform also reserves the right to suspend or block your User account for a fixed number of days if it is noticed that you are constantly losing exorbitant amounts. Please note that this will be done solely in your best interest.

Limitation of Liability and Indemnity

50.   You agree that your use of the Platform and its Services is entirely at your own discretion. The Platform is not liable for any and all consequences resulting from your lawful or unlawful access, use of the Platform and the Services offered by it.

51.   You agree that the Platform is not responsible for any issues faced by you, including on account of slow internet connections, faulty hardware, internet connection failure, low computer configuration or for any other reason not attributable to the Platform which may hinder, stop or affect your participation in any Lottery draw offered on this Platform. The Platform is also not responsible for any third-party products or services that may be advertised on or received through any links or other sources provided on the Platform or any information, content or advice received through the Platform or links provided on the Platform.

52.   You agree to defend, pay, indemnify, and hold harmless the Platform and the Company, along with its licensors, subsidiaries, affiliates, associates, partners and agents from any and all losses, costs, expenses, damages, or other liabilities resulting from any claim, lawsuit, demand, or action brought by any third party or any Government claims. This includes any and all liabilities or costs incurred by the Platform or the Company arising from (a) your access and/or use of the Platform, (b) accessing, attempting to register from an Unauthorized Jurisdiction, providing any false information or using any unauthorized measures for unlawfully accessing, registering and using the Platform; (c) your breach of any of the Platform Policies or applicable laws; (d) any fraud, negligence, wilful misconduct, misrepresentation, forgery, cheating, defamation or intentional wrongdoing on your part; or (e) any action or inaction on your part which may prejudicially impact the business, operations, goodwill and reputation of the Platform/Company and its Services.

53.   The Company will not be held responsible for any direct, indirect, remote, punitive, special, incidental, consequential or exemplary damages (such as, but not limited to, loss of business, revenue, profits, or goodwill) resulting from or related to the Platform or the Services. This includes, but is not limited to, any loss arising from: (a) the use or inability to use the Platform, (b) the actions and conduct of any User on the Platform, (c) unauthorized access to or modification of data or transmissions, (d) malicious or criminal activities, or fraudulent transactions by the User, and (e) technical or operational hindrances/errors on the Platform. In any case, the Company’s liability under the Agreement will not exceed the price of the Lottery Ticket that is the subject of the dispute between the Company and the User on the Platform.

Governing Law & Dispute Resolution

54.   The Platform Policies, along with your use of the Platform, are governed by and interpreted in accordance with the laws of India, notwithstanding any conflict of law provisions. Either Party has the right to seek interim relief at the appropriate forums or courts with proper jurisdiction. In the event of any dispute arising from the Platform Policies or your use of the Platform, you may file a claim against the Company. The courts in Goa will have exclusive jurisdiction over all matters related to the Platform Policies and your use of the Platform. It is specified that the Company will not be liable for any claims related to Lotteries where the prize money exceeds INR 10,000/-, and any such claims should be directed towards the Government.

General Provisions

55.   Entire Agreement: The Platform Policies constitute an entire, valid and binding agreement between you and the Company and governs your access and use of the Platform at all times.

56.   Advertisement: the Company shall have the right to place advertisements and publicity materials of its choice, including that pertaining to parties other than itself for commercial use through electronic means on the Platform.

57.   Waiver: The failure of the Platform to exercise any right provided for herein shall not be deemed a waiver of its any further right hereunder and under any of the Platform Policies and applicable laws.

58.   Assignment: You may not assign or sub-license, without the prior written consent of the Company, the rights, duties or obligations under the Platform Policies, in whole or in part, to any person or entity. The Company may assign or sub-license in whole or in part any of its rights, duties or obligations under the Platform Policies to any of its affiliates.
